By this application, the applicant has sought to direct the learned Civil Judge, Senior Division, Kalyan to expedite the hearing and dispose of the Marriage Petition No.451 of 2005 in time bound frame.

The learned Counsel for the petitioner as well as the learned Counsel for the respondent submit that the evidence of the petitioner husband is already recorded and the case is at the stage of defence evidence. It is further submitted that the respondent, wife is under cross examination and that she does not intend examining any further witnesses.

Considering the above statement and also considering the fact pps

42 caw 918-17.doc that the case is of the year 2005, the learned Civil Judge, Senior Division, Kalyan is directed to dispose of the Marriage Petition No.451 of 2005 as expeditiously as possible, and in any event within a period of four months from the date of receipt of this Order. Civil Application stands disposed of accordingly.
