The above Civil Application has been filed by the original Civil Revision Applicant seeking extension of time to vacate the premises and for being permitted / allowed to deposit compensation @ Rs.32,000/- per month in the Small Causes Court, Mumbai as hitherto or in the alternative to pay the said amount directly to the Respondent No.1 till the period granted by this Hon'ble Court comes to an end.

In so far as the said reliefs are concerned, the parties have arrived at an amicable settlement and have recorded the said settlement in the consent terms bearing today's date i.e. 30-3-2017, which have been tendered by the Learned Counsel for the parties. The consent terms therefore evidence mmj

The Learned Counsel Mr. Uraizee appearing for the Applicant and the Learned Counsel Mr. Shah appearing for the Respondent No.1 prayed that the above Civil Application be disposed of in terms of the said consent terms. The consent terms have been signed by the Learned Advocates for the parties i.e. Mr. Uraizee for the Applicant and Mr. Shah for the Respondent No.1. The consent terms have also been signed by the parties Mr. Ranjit Singh partner of the Applicant and Mrs. Lata Shah i.e. the Respondent No.1. When put in the box and queried Mr. Ranjit Singh states that he has read the consent terms and that they are acceptable to him and that he has signed them of his own free will and volition. The Learned Counsel Mr. Shah identifies Mrs. Lata Shah as being the Respondent No.1, she is also identified by her Pan Card No.AQXPS6428F, which she has produced. When put in the box and queried, she states that she has read the consent terms and that they are acceptable to her and that she has signed them of her own free will and volition.

The undertakings mentioned in paragraphs 5 to 8 are accepted. The consent terms are paginated from page Nos.1 to 6. The consent terms are marked as "X" for identification. The Civil Application is disposed of in terms of the consent terms.
