This is an application seeking permission to travel abroad. Learned advocate for the applicant submits that prayers made in this application have become infructuous since the applicant was to travel abroad during the period between 1st April 2017 and 30th September 2017. The application preferred before the Trial Court was rejected on 19th November 2016.

Learned counsel for applicant submits that in case need arises, the petitioner would prefer a fresh application before the Trial Court. On instructions he seeks leave to withdraw this application with liberty to file a fresh application as and when need arise. 3.
Leave granted. Criminal Application No.365 of 2017 is dismissed as withdrawn with liberty to file a fresh application on
2 of 2 7.APL.365.2017 fresh cause of action before the Trial Court. In case such an application is filed, the Trial Court shall deal with such application without being influenced by the earlier rejection and in accordance with law.
