Heard Mr.Harshvardhan Akolkar, learned counsel for the applicant. Heard Mr.V.B.Konde Deshmukh, learned APP for the State.

I am informed that a charge-sheet has not yet been filed. Investigating Officer is not present. However, the learned APP states that intimation has duly been given to the concerned police station.

The applicant intends to be abroad only for a short duration.

Considering all the relevant aspects of the matter, I am inclined to allow the applicant to depart from India on certain terms and conditions.

Tilak 2/3 (6)APPP-249-16 The applicant is permitted to depart from India during the period from 25th April 2016 to 8th May 2016 (both days inclusive) on the following conditions :

i) The applicant shall furnish a surety in the sum of Rs.1,00,000/- or cash in the sum of Rs.1,00,000/- as and by way of additional security for his appearance before the Investigating Agency and/or the Court;

ii) The applicant shall not visit any countries, except Singapore and Korea;

iii)The applicant shall give, in writing, his travel details such as ticket number, flight number etc. to the Investigating Agency atleast 24 hours before his actual departure; iv) The applicant shall intimate to the Investigating Agency his contact telephone numbers and the address/addresses abroad where he would be available for communication during the aforesaid period;

v) The applicant shall, in any event, return to India by 9th May 2016 and report compliance to this Court within a period of one week thereafter.

vi) The applicant shall surrender his passport back to the Investigating Agency within three days from his return to India.

On the applicant executing a bond with a surety/cash security in accordance with this order binding himself to abide by the above conditions, the passport of the applicant be returned to him.
