Heard learned counsel for the applicant and learned APP for the State.

This is an application for bail in respect of the offence punishable under Sections 370(3) of the Indian Penal Code and Sections 3, 4, 5 and 8 of the Immoral Traffic (Prevention) Act, 1956, registered on 13/10/2022 vide C.R. No.851 of 2022 with Yavat Police Station, Pune. 3.

The applicant was arrested on 13/10/2022. The applicant is accused No.2. It is the accusation that the applicant was the manager of the hotel where the prostitution activities were being indulged. It is the case of 1/3

the prosecution that from the earnings of the victims, the applicant was receiving money.

Learned APP opposed the application and invited my attention to the statement of the victims recorded under Section 161 of the Cr.P.C. It is also submitted that the applicant's wife is also a victim.

The statements of the victims recorded under Section 164 of the Code of Criminal Procedure (Cr.P.C.) reveal that they had voluntarily gone to the hotel. There are no accusations against the applicant. In the facts of the present case, as the applicant is in custody for more than a year, the investigation is complete and the charge-sheet has been filed, I am inclined to enlarge the applicant on bail. There are no criminal antecedents reported against the applicant. Hence, the following order :-

O R D E R

(a) The application is allowed.

(b) The applicant- Rupesh Kisan Jungare in connection with C.R. No.851 of 2022 registered with Yavat Police Station shall be released on bail on his/her furnishing P.R. Bond of Rs.15,000/- with one or 2/3

more sureties in the like amount.

(c) The applicant shall attend the Investigating Officer of Yavat police station once in a month every first Monday of the month between 11.00 a.m. and 1.00 p.m.

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not tamper with evidence. (e) On being released on bail, the applicant shall furnish his contact number and residential address to the Investigating Officer and shall keep him updated, in case there is any change.

(f) The applicant shall attend the trial regularly. The applicant shall co-operate with the trial Court and shall not seek unnecessary adjournments.

The application is disposed of.
