Learned Counsel for the applicant does not press this application. He prays that he may be granted liberty to file an appropriate SQ Pathan 1/2

apl.320.16.27.doc application for transfer of the said amount of Rs. 45 lakhs to the firm i.e. Venus Developers.

Accordingly, the application is disposed of as withdrawn with liberty as prayed.

If such an application is filed seeking transfer of Rs. 45 lakhs to the firm, the same shall be decided by the learned Magistrate on its own merits in accordance with law, as expeditiously as possible. 4.

In view of the aforesaid order, Criminal Application No. 746 of 2016 does not survive and is disposed of accordingly. REVATI MOHITE DERE, J.
