IN THE HIGH COURT OF JUDICATURE AT BOMBAY

APPELLATE CIVIL JURISDICTION WRIT PETTION NO. 4903 OF 2002 Naik Sahakari Sakhar Karkhana Ltd.

.... Petitioner vs State of Maharashtra and anr .... Respondents None for the Petitioner Mr. S.D. Rayrikar, AGP for the Respondent No.1. CORAM: ANOOP V. MOHTA, J.

DATE : February 04, 2015 P.C.:

Pending the dispute, by interim order, Maharashtra State Cooperative Appellate Court, allowing the Appeal partly, directed the society not to implement resolution dated 27.07.2002 until the dispute is decided finally. This Court, while admitting the Petition, granted the stay in terms of prayer (b), that resulted into the stay of the impugned order so referred above. This itself means the society must have acted upon the resolution in question in the year 2002 itself.

906-wp-4903-2002.sxw Therefore, taking overall view of the matter, I see there is no reason to keep this matter pending. The issue must have decided finally even in the dispute so referred. Therefore, the present writ petition is disposed of as infructuous as there is nothing on record to show that this order passed by this Court has challenged further. Rule discharged accordingly. No costs.
