Having heard Dr.Tulzapurkar, learned senior counsel for the petitioner and Mrs. Thakur, learned AGP, we deem it convenient to dispose of this petition with direction to the appellate authorityrespondent No.3 (Collector of Stamps, Mumbai) to dispose of the petitioner's appeal No.80 of 2010 challenging the order dated 16th October, 2010 passed by the respondent No.2 (Superintendent of Stamps (HQ)) as expeditiously as possible and preferably within a period of four weeks from the date of receipt of this order. Ordered accordingly.

Till disposal of the said appeal, the interim order passed by this Court on 27th March, 2017, shall remain in operation. In the event, any order, adverse to the interest of the petitioner is passed by the appellate authority, the same shall remain stayed for a period of two weeks from the date of the communication of the same. 3.

It is made clear that we have not gone into the merits of the matter and, therefore, the appellate authority shall dispose of the said appeal independently on its own merits and in accordance with law. All rights and contentions of the respective parties are kept expressly open. 4.
