The petition is filed for quashing and setting aside the subject FIR bearing C.R.No.I-119/14 registered with Tilak Nagar Police Station, District Thane, under Sections 406, 420 and 506 r/w 34 of the IPC.

The learned APP, on instructions, makes a statement that the subject FIR is investigated and the charge-sheet is also filed in the Court of Judicial Magistrate First Class, 3rd Court, at Kalyan. A copy of the charge-sheet is placed on record.

in the light of the above, we are not inclined to entertain this petition, inasmuch as, the petitioner has an alternate remedy to apply for discharge before the trial Court.
