The applicant/accused who is directed to be released on bail by order dated 5 December 2022 is still languishing in jail due to rejection of surety by the Trial Court on the ground that the surety has not produced PAN card.

On perusal of the office remarks by the Assistant Registrar, City Civil & Sessions Court, Greater Bombay, it appears that the surety is friend of applicant knowing him for five years; surety is a farmer earning Rs.20,000/- per month; ration card, Aadhar Card, Electricity Bill verified through originals; and surety furnished solvency certificate issued by the Tahsildar, Barshitakli, Akola in

906-apl400-2023.doc the sum of Rs.50,000/- dated 10 January 2023. 3.

In my opinion, aforesaid four conditions satisfies the requirements of surety. Hence, the applicant shall be released on bail by treating the surety submitted as valid surety as per order dated 5 December 2022.

The criminal application stands disposed of in above terms. No costs.
