By this Civil Application, Applicants Original defendants are seeking condonation of 142 days delay in filing First Appeal challenging the Judgment and Decree dated 3.9.2016 passed by the City Civil Court in S.C.Suit No. 4187 of 2009 (H.C.Suit No.2230 of 2009).

Considering the submissions made by the learned Counsel for the Applicant and averments made in Civil Application, I am satisfied that

Hence, the following order is passed:

a) Delay in filing First Appeal, is condoned.
