This is an appeal for modification of conditions stipulated in order dated 22nd June, 2021 passed by the learned Special Judge and Additional Sessions Judge, Pune in Criminal Bail Application No.3298 of 2021, wherein the appellants were directed to attend Lonikand Police Station, Pune on 1st Sunday of each month between 10.00 a.m. to 12.00 noon, till commencement of trial. Learned counsel for the appellant submitted that the case is due for framing charge. The appellants have been attending the Police Station as per the directions. One of the appellant is ailing and appellant No.4 is required to be visited at Rajasthan, since his father is not keeping well.

Learned APP submitted that to secure the presence of the appellant there has to be some check by way of condition of attendance.

Considering the submissions of both the sides, I pass the following order :-

ORDER

i.

Criminal Appeal No.345 of 2022 is allowed and disposed of.

ii.

Order dated 22nd June, 2021 is modified and the appellants are directed to attend Lonikand Police Station, Pune once in three months on first Saturday of the month between 11.00 am. to 1.00 noon, till commencement of trial.
