IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION APPEAL FROM ORDER NO. 443 OF 2015 IN CIVIL APPLICATION NO. 578 OF 2015 Arti Sameer Harlalka ...Appellant
Versus
Re-Built & Ors
...Respondents
WITH APPEAL FROM ORDER NO. 445 OF 2015 IN CIVIL APPLICATION NO. 580 OF 2015 WITH CIVIL APPLICATION (ST) NO. 8557 OF 2017 WITH APPEAL FROM ORDER NO. 446 OF 2015 IN CIVIL APPLICATION (ST) NO. 8562 OF 2017 WITH APPEAL FROM ORDER NO. 448 OF 2015 IN CIVIL APPLICATION NO. 584 OF 2015 WITH CIVIL APPLICATION (ST) NO. 8565 OF 2017
Mr Siddharth Murarka, for the Appellants/Applicants.
Ms Gayatri Sharma, a/w Ms Khushboo Rupani, i/b SK Srivastav & Co, for Respondent No. 2.
Mr Nitesh V Bhuekar, for Respondent No. 4.
CORAM: G.S. PATEL, J DATED:
PC:- 1.
Mr Murarka for the Appellants fairly states that the Appeals are not maintainable. He has filed a Writ Petition instead. He seeks to withdraw the appeals, which are dismissed as withdrawn. 2.
Since there is an ad-interim relief that has been continued since 6th February 2015 when it was granted by the Trial Court and 6th April 2015 when it was continued by this Court in Appeal, I will have little choice but to extend that ad-interim relief for a further period of two weeks from today. It will not be possible to accept Mr Murarka's request that the ad-interim order should continue for a further period of four weeks since the Appeals themselves are not maintainable. This continuance is purely a matter of concession and indulgence.
3.
Finally, it is clarified that this order is without assessment on merits of the Appeals or of the conduct of the parties before or after the impugned order.
4.
The corresponding Civil Applications by either side are infructuous and are also disposed of as such. (G. S. PATEL, J.)
