DATED : 23rd AUGUST 2022 P.C:- The applicant is charged u/s. 364-A, 384, 386, 387, 342, r/w Section 120B of the IPC, in connection with C.R.No.417/2021 registered with Sahar police station. He is arraigned as accused no.1 and along with him six other persons are charge-sheeted. It is submitted that five of the co-accused are released on bail, whereas one co-accused Rajeev Kumar Arya who was not charge-sheeted, but was arraigned as accused, was released on bail in anticipation of his arrest.
2/3 62 BA 1146-22 modified.doc With the assistance of the learned counsel for the applicant, I have perused the orders passed in respect of the coaccused by the Sessions Court who have been released on bail. The charge-sheet allege that the present applicant called one Balit Pavan Rao near hotel J.W. Mariott for a meeting, and thereafter, with the help of the other co-accused, he was forcibly made to sit in a taxi and taken to Kranti Nagar, Kandivli (East), where he was confined to one room. Ransom of Rs.35 lakhs was demanded from one Mallikarjun Rao, his employer and he was threatened that if the amount is not paid, the abducted person would be done to death. However, since Malikarjun Rao did not respond to the said demand, the other associates of the applicant left the place and Mr.
Rao was taken to Nalasopara, and thereafter the applicant is alleged to have made phone call to Malikarjun Rao, and pursuant to which a sum of Rs.96,000/- came to be deposited by Google Pay Application in the account of the co-accused Prince Jitendra Singh, who is already released on bail. Since the accusations against the present applicant are crystallized in the charge-sheet, and though it has surfaced that he has played an active role in the entire episode, and at his instance, an amount of Rs.96,000/- by way of ransom was paid by Malikarjuna Rao, however, the amount is received in the account of accused no.2, Prince Singh.
The applicant would take the consequences of the accusations at the time of trial, but since no flight risk is
3/3 62 BA 1146-22 modified.doc apprehend by the prosecution and since no antecedents are reported against him, in the wake of the release of all the coaccused, he deserve his release on bail. Hence, the following order:-
O R D E R
(a) The Applicant - Indrajeet S. Singh in connection of C.R.No.417/2021 registered with Sahar police station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.
(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
(c) The Applicant shall mark his attendance with the Investigating Officer on first Saturday of trimester.
