1] This is an application under Section 439 of Cr. P.C. for bail in CR No. 255 of 2018 dated 17.8.2018 registered with Kopar Khairane Police Station, Navi Mumbai under Section 420, 406 read with 34 of the Indian Penal Code and under sections 3 and 4 of Maharashtra Protection of Investors And Depositors Act, 2000.

2] Heard the learned Counsel for the applicant and the learned APP. Perused the record produced before me.

3] It is the prosecution case that, the applicant was an employee of Gaonkari Nidhi Ltd., a finance company formed by the principal accused Deepak Gavali. The co-accused Dattatraya Patil was also an employee of the 1/3

said bank. It is alleged that, the said Dattatraya Patil induced the investors to invest amounts in the said Company. The record indicates that, the said co-accused Dattatray Patil has been released on bail by the learned Judicial Magistrate First Class. The record further indicates that, the principal accused Deepak Gawli is not yet arrested. No role is attributed to the present applicant in the first information report and/or in the statements of the witnesses. It prima facie appears that, The applicant being the employee of the said Gaonkari Nidhi Ltd., has been roped in the present crime. The role attributed to the applicant appears to be lesser than the role played by the principal accused in the present crime.

4] In view of the above, the applicant can be released on bail. Hence the following Order:

i] Applicants be released on bail in CR No. 255 of 2018 registered with Kopar Khairane Police Station, Navi Mumbai, on his furnishing PR bond of Rs.20,000/- with one or two solvent local sureties in the like amount.

ii] The applicant shall attend all the dates before the Trial Court unless granted exemption by the concerned Court. iii] Applicant shall not tamper with the evidence and/or influence 2/3

the prosecution witnesses.
