The learned counsel for the Applicant submits that by this Civil Application Applicant is seeking to bring legal heirs on record of appellant Prabhakar J. Pise who died on 19.2.2019.

He submits that Civil Application is filed on 13.3.2019 i.e. within time.

510 caf1295-19.doc averments made in Civil Application and as Application is filed within time, I am satisfied that the Applicant has made out a case for allowing the Civil Application. Hence, following order is passed:

a.

Applicant is permitted to bring legal heirs on record of deceased sole appellant in First Appeal (St.) No.23606 of 2018 on or before 26.4.2019 failing which Civil Application shall stand dismissed without referring back to the court.

b.

Civil Application stands disposed of accordingly.
