At the outset, the learned counsel for applicant submitted that the applicant is not pressing prayer clause 'b' of this application. Prayer clause 'a' is regarding direction to the Regional Passport office to consider the application for issuance of passport. 2.

Leave to amend to add Passport Authority as respondent No.3. Amendment may be carried out forthwith. 3.

The applicant has been convicted for offence punishable under Section 13(1)(e) of the Prevention of Corruption Act. The appeal preferred by the applicant has been admitted by this Court and it is pending for final hearing. The sentence of by SAJAKALI LIYAKAT JAMADAR Date:

In view of requisite circular, the applicant is required to seek permission from the Court where the criminal proceedings are pending for preferring an application for issuance of passport. 5.

In these circumstances, this application can be allowed.

In the event, the applicant prefers the application for issuance of passport, the respondent No.3 shall issue the passport on compliance of rules and regulations for a period of five years. 7.

Interim Application No.272 of 2020 stands disposed off accordingly.
