Heard the applicant appearing in person. He seeks permission to withdraw the application with liberty to file appropriate proceedings for challenging the order dated 27th August 2013 passed by the learned Metropolitan Magistrate by which the application made by the applicant for discharge was rejected.

Accordingly, we dispose of the application with liberty as prayed. All contentions on merits are kept open.
