1] This is an application for suspension of sentence and for releasing the applicant on bail.

2] Heard the learned Counsel for the applicant and the learned APP. Perused the record.

3] The applicant is convicted under section 138 of Negotiable Instruments Act and is sentenced to suffer simple imprisonment till rising of the Court and directed to pay compensation of Rs.1,20,000/-, in default of payment of compensation, to further suffer simple imprisonment for two months by the learned 5th Judicial Magistrate First Class, Thane in S.C.C. 1/2

APPR.186-2017.doc No.2499 of 2007, by its Judgment and Order dated 02.05.2014. Criminal Appeal bearing No. 3 of 2015 preferred by the applicant has been dismissed by the learned Additional Sessions Judge-06, Thane by its Judgment and Order dated 12.01.2017.

4] The learned counsel for the applicant submitted that, the applicant has already undergone the sentence of simple imprisonment till rising of the Court and is also ready and willing to deposit Rs.1,20,000/- in the Registry of this Court within a period of two weeks from today. The statement made by the learned counsel for the applicant is accepted.
