The learned Counsel for the petitioner submits that the petitioner is aggrieved by the fact that the juniors of the petitioner are promoted as Headmaster.

It would be a case of supersession. As per Rule 14 of Maharashtra Zilla Parishad District Services (Discipline and Appeal) Rules, 1964, the petitioner can approach the Commissioner.

The learned Counsel for the petitioner submits that he has approached the Commissioner, however, no decision is taken by the Commissioner.

In case, the application is fled by the petitioner (page

42) with the respondent No.2, then the respondent no.2 shall treat it as an appeal and shall take decision upon it in accordance with law, if required, after hearing of all the parties expeditiously preferably within six months. 5.

The writ petition is disposed of. No costs.
