The petitioner is the maternal uncle of the first informant's husband. He submits that the petitioner has undergone bypass surgery in the recent days and has also retired from the Customs Department. He submits that because of the pendency of the case i.e. CC No. 416/PW/2015 (arising out of FIR No. 317/2015 registered with Nehru Nagar Police Station), pending on the file of the learned Metropolitan Magistrate, 34th Court, Vikhroli, Mumbai, gratuity, commutation of pension and other ancillary payments are withheld by the said Department. 39-wp-2500-2021.doc Since the Court is inclined to expedite the proceeding as against the petitioner, learned counsel does not press the aforesaid petition on merits and seeks leave to withdraw the same. Considering that charge has been framed in the said case, the learned Judge to decide the said case as expeditiously as possible and preferably on or before 31st December 2021. All parties to cooperate in the conduct of the trial.

It is made clear that this petition has not been considered on merits.

Petition is disposed of on the aforesaid terms. Copy of the above order be sent to the the learned Metropolitan Magistrate, 34th Court, Vikhroli, Mumbai, who is seized of the matter. REVATI MOHITE DERE, J.
