DATE: OCTOBER 12, 2021 P.C.:- 1] Applicant came to be arrested on 15/12/2020 in Crime No.430 of 2020 registered with Nalasopara Police Station for the offence punishable under Sections 420, 511, 34 of the I.P.C. and Sections 3 and 4 of the M.P.I.D. Act read with Section 66(D) of the I.T. Act and is chargesheeted.

2] The role attributed to the Applicant in the crime is that of employee of the company. The task entrusted, as per prosecution, to the Applicant by the co-accused Directors is to solicit customers and promote them to deposit amounts in the Company with a promise of hefty returns. As far as investigation against the Applicant is concerned, only role that could be inferred is, acting as an employee of the Company of which other co-accused are Directors. Applicant 1/2

65. BA-1397-2021.doc called the customers and requested them to give deposits and promised hefty returns on behalf of the Company. During investigation, apart from above, no other involvement of the Applicant is noticed as he is neither beneficiary nor has directly or indirectly participated in decision making process of the Company. There are no criminal antecedents against the Applicant. That being so, case for grant of bail is made out.

3] Applicant is directed to be released on bail in Crime No.430 of 2020 registered with Nalasopara Police Station for the offence punishable under Sections 420, 511, 34 of the I.P.C. and Sections 3 and 4 of the M.P.I.D. Act read with Section 66(D) of the I.T. Act, upon furnishing P.R. Bond in the sum of Rs 15,000/- with one or more sureties in the like amount. Applicant shall neither tamper with the evidence nor directly or indirectly try to influence the prosecution witnesses and the complainant. The Applicant shall furnish the particulars of his place of residence and contact details to the Investigating Officer of the Police Station concerned within seven days from today.
