Mr. Ashish Singh, Senior Executive of the Respondent Company has appeared in person and has produced copy of the Resolution authorizing him to appear in this matter on behalf of the Respondent Company. Learned Counsel for the Petitioner invites my attention to para 22 (a) of the Petition wherein the Petitioner has nominated Mr. Justice R.S. Mohite (Retd.) of Mumbai as their Arbitrator. Mr. Ashish Singh, Senior Executive of the Respondent states that the Company nominates Mr. Justice Suman D. Pandit as their Arbitrator.

a) Mr. Justice R.S. Mohite (Retd.) (nominated by the Petitioner) and Mr. Justice Suman D Pandit (Retd.) (nominated by the Respondent) are appointed as Arbitrators under the Arbitration & Conciliation Act, 1996. b) The aforesaid Arbitrators shall appoint the third Arbitrator, which shall constitute the Arbitral Tribunal and adjudicate the disputes and differences between the parties.

c) Registry to communicate a copy of this order to the Arbitrators together with a memorandum of address of parties.
