The above Writ Petition has been filed for quashing of the FIR being C.R. No.189 of 2013 registered with the Kashimira Police Station District Thane by the Respondent No.2 herein for the offences punishable under Sections 325, 323, 504, 506, 487, 109, 34 of the Indian Penal Code. The learned counsel for the Petitioner Shir A M Saraogi informs us that the CC TV footage of the society has been made available to the investigating agency. Upon this, the learned APP informs us that the said CC TV footage has been taken into consideration prior to registration of the FIR. She further informs us that the charge-sheet has been filed. In view of the fact that the said CR is under investigation, we do not deem it appropriate to interfere with the said investigation at this stage. It lgc
(32) wp-1375.18.doc would be contingent upon the decision that would be taken by the investigating agency at the end of the investigation that the Petitioner can thereafter seek appropriate recourse in law. If the charge-sheet is already filed, then it would be open for the Petitioner to seek appropriate recourse under the Criminal Procedure Code. It is therefore not necessary to keep the above Writ Petition pending. The same to accordingly stand disposed of.
