P.C.:- Present Petition is directed against the impugned Order dated 14th November, 2014 passed in Miscellaneous Application No.60 of 2014 by the learned Member of the Maharashtra State Co-operative Appellate Court (Mumbai), Bench at Pune thereby dismissing the said Miscellaneous Application. By the said Application, the Petitioner had challenged the order of refusing to condone delay of 184 days filed against the impugned Order dated 30th November, 2013 passed on preliminary issue by the learned Judge of the Co-operative Court No.2, Pune. By the said Order dated 30th November, 2013, the Co-operative Court has held that, it has jurisdiction under Section 91 of the Maharashtra Co-operative Societies Act, 1960 to try and entertain the dispute filed by the Respondent No.1. 1/2

It is to be noted here that, the Petitioner has filed present Petition against the impugned Order dated 14th November, 2014 on 26th March, 2015 and since then the Petition is not seriously pursued by the Petitioner till date. In the interregnum as per the submission of Advocate Mr. Kanetkar, the Co-operative Court has proceeded further and the crossexamination of Respondent No.1 has already begun. 3.
In view thereof, this Court finds that, the present Petition has became infructuous and is accordingly dismissed in limine. (A.S. GADKARI, J.) 2/2
