Mr. Kate, learned counsel for the Petitioner states that since the present Petition challenges suspension and during the pendency of the Petition the Petitioner has already been terminated. The Petitioner seeks liberty to withdraw the Petition.

The Petitioner however, presses for expeditious disposal of the Appeal which is filed by the Petitioner challenging his termination. Hence the Petition is, therefore, disposed of as withdrawn. 1/2

The learned School Tribunal is directed to dispose of the Appeal filed by the Petitioner as early as possible. It is further made clear that if the Respondent management seeks unwarranted adjournment, the learned School Tribunal would be at liberty to draw adverse inference against the management.
