Learned counsel for the petitioner on instructions seeks leave to withdraw the petition. He submits that during the pendency of the petition, the suit has been disposed off. Learned counsel however, seeks liberty to raise all the contentions raised in the petition before the District Court, Kolhapur i.e. Appellate Court. Needless to state, that all contentions raised in this petition are kept open. It is made clear that the petition has not been heard on merits.

Petition is disposed off as withdrawn with the aforesaid observations.
