Heard learned counsel for the applicant and learned APP for the State.

The application has filed this application seeking temporary bail as he desires to appear for the second year final examination of Bachelor of Arts for April / May, 2016. The examinations are conducted by the Savitribai Phule Pune University. The examinations are to commence from 5th April, 2016 and the last paper is scheduled on 20th April, 2016. The 1/3

applicant, therefore, prays for release on temporary bail from 3rd April, 2016 till 21st April, 2016.

The applicant has annexed orders granting him temporary bail on earlier occasions. Counsel for the applicant further submits that on earlier four occasions the applicant was released on parole and he has surrendered in time. 4.

We have perused the record placed before us. The applicant is not aware of the Centre which is allotted to him for the written examination of Bachelor of Arts. In the facts, we pass the following order:- (i) The applicant Suyash @ Joy Satish Dixit at present lodged in Yerwada Central Prison, Pune in connection with Sessions Case No.682/2009 for an offence punishable under section 302 of the Indian Penal Code, decided on 23rd May, 2012 by the Additional Sessions Judge, Pune, is directed to be released on temporary bail with effect from 3rd April, 2016 till 21st April, 2016;

(ii) The applicant shall be released on bail on his furnishing 2/3

cash security of Rs.10,000/- to be furnished in the trial Court;

(iii) The applicant shall surrender to his bail on 22nd April, 2016 before 5.00 p.m.;

(iv) The application is disposed of.

All concerned to act upon an authenticated copy of this order.
