The learned APP on instructions states that on 26th July 2016, a report has been filed by the Investigating Officer claiming `A' summary. Hence, at this stage, we need not entertain this application for quashing the FIR.

Accordingly, we dispose of the application by passing the following order:

(I) The learned Metropolitan Magistrate shall pass an appropriate order on the `A' summary report after notice to the First Informant;

apl290 (ii) In the event, the `A' summary report is not accepted, we grant liberty to the applicant to file appropriate proceedings.
