1) By this application under Section 482 of Cr. P.C. the applicant has prayed that the Chapter Court Case No.304 of 2015 pending before the Special Executive Magistrate, Dombivli East be quashed and set aside. 2) During the course of argument, the learned counsel for the applicant fairly submitted that as a matter of fact the proceedings are now concluded and the applicant has been directed to furnish a bond. 3) The learned APP submitted that the since the final order is passed in the proceedings initiated by the Special Executive Magistrate, a Revision is maintainable before the Sessions Court.

Dond 1/2 apl.327-2016.sxw 4) In view of the above, the learned counsel for the applicant on instructions seeks leave to withdraw the present application with liberty to file a Revision Application before the Sessions Court. 5) Leave and liberty granted.
