The wife has filed present application seeking transfer of Marriage Petition bearing No.27 of 2022 pending before the learned District and Sessions Court, Pune to the learned District and Sessions Court, Panvel.

On 18th October, 2012 the applicant and respondent got married.

Since the marriage between the applicant and respondent is under Special Marriage Act,1955. The respondent filed divorce petition bearing No.27 of 2022 before the learned District and Sessions Judge, Pune. The applicant, has, therefore filed present application seeking transfer to the learned District and Sessions Judge at Panvel.

The applicant has stated that she is currently residing at with her mother at Kamothe, Navi Mumbai the distance between Pune to Kamothe is around 120 kilometers and, therefore, it is inconvenient her to attend the proceedings before the Court at Pune.

The respondent has been served through the Court. But none appears for the respondent.

Considering the reasons in paragraph 4. The applicant has made out a case for transfer. Hence, following order. 7.

The Miscellaneous Civil Application is allowed in terms of prayer clause (a).
