Considering the impugned order dated 08/12/2022 passed by the Metropolitan Magistrate in C.C. No. 1806/Misc/2022, we are not inclined to cause interference in extraordinary jurisdiction under Article 226 of the Constitution of India.

However, the Petitioner is granted liberty to work out the matter thereby lodging his objections to the report submitted by the investigating ofÏcer u/s. 169 of Cr.P.C.

The Magistrate is expected to deal with the objections of the Petitioner while accepting the report submitted by the investigating ofÏcer u/s. 169 of Cr.P.C 4.
