Heard Mr. Amare, learned Counsel for the petitioner and Mr. Pathade, learned Counsel for the respondent.

Learned Counsel for the parties submit that controversy between the parties is amicably settled. As per calculations of the parties, petitioner is liable to pay Rs.1,70,24,000/- (Rs. One crore, seventy lakh, twenty four thousand only) to the respondent.

Mr. Amare submits that respondent may waive claim of Rs. 24,000/- and within one week from today, the petitioner will issue banker's cheque in the sum of Rs. 1,70,000,00/- in favour of the respondent. Mr. Pathade fairly waives Rs. 24,000/- to put an end to the entire controversy. 4.

In view thereof, Petition is disposed of in the following terms; Petitioner shall pay Rs. 1,70,00,000/- to the respondent within one week from today towards full and final settlement of its claim.
