According to prosecution, the informant was being carried out construction of his bungalow since July 2021. During last stage of construction, he had brought construction material at the site described in the report. According to informant, unknown persons committed theft of articles. According to prosecution during investigation name of applicant surfaced.

According to applicant, the juvenile co-accused Shubham Sachin Gaikwad has been released on bail. The applicant is taking education in ITI (Electrical). He is doing agricultural and labour work and his entire family members are dependent on him. He has no antecedents to his discredit. Except disclosure statement of Ratan Dagadu Lathad, there is no material on record to connect the applicant with the alleged offence. Therefore, the applicant has

45-aba-866-2023.doc made out a case for confirmation of ad-interim relief granted by this Court on 27 June 2023. Hence, following order: a) Ad-interim relief granted by this Court on 27 June 2023 is confirmed subject to following additional conditions;

b) The applicant shall not directly or indirectly make any inducement, threat or promise to any witness acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer. c) The applicant shall not obstruct or hamper the police investigation and not to play mischief with the evidence collected or yet to be collected by the police. 3.

The anticipatory bail application stands disposed of in above terms. No costs.
