DATED : 11th NOVEMBER, 2022 P.C:- When I express my disinclination to entertain the application, in the wake of the material compiled in the chargesheet, the learned counsel for the applicant seek permission to withdraw the application. Permission is granted. Application is disposed off as withdrawn.

The learned counsel would however make a request to expedite the trial since the applicant remain incarcerated since 12/4/2018 and despite four years, the trial is not concluded. The learned APP state that charge has been framed and the prosecution has cited 12 witnesses for trial. Tilak

2/2 9 BA 1405-21.doc In the aforesaid circumstances, since speedy trial is a fundamental right of an accused, and has been held to be an integral part of Article 21, I deem it appropriate to request the Sessions Judge, Mumbai, to conclude the proceedings in Sessions case No.473/2018 as expeditiously as possible, and in any case, not later than eight months from today.

The learned Judge is requested to adjust the trial calendar accordingly.

If the trial is not concluded within eight months as directed, the applicant is at liberty to renew his request for being released on bail on the ground of long incarceration. ( SMT. BHARATI DANGRE, J.) Tilak
