The Applicant-Insurance Company has sought restoration of the appeal, which was dismissed for non compliance of order dated 28/10/2010 passed in Civil Application No.640 of 2007, which was for condonation of delay in filing the appeal.

By order dated 28/10/2020 this Court had extended time to carry out amendment and had put the Appellant to notice that on failure to carry out the amendment within the stipulated time, the delay condonation application as well as the application for stay would stand dismissed. In the light of the said statement and in view of the reasons stated in the application, the appeal as well as delay condonation application being Civil Application No.640 of 2007 and stay application being Civil Application No.641 of 2007 stand restored. 4.

The Interim Application stands disposed of.
