Heard learned counsel for the applicant.

By this application, the Applicant seeks modification/relaxation of the condition imposed by this Court (Coram:N.W.Sambre,J.) vide order dated 17th November, 2016, passed in Anticipatory Bail Application No.1950 of 2016.

Learned Counsel for the applicant submits that the applicant is unable to furnish the surety of Rs.50,000/-. He submitted that all the other co-accused have been granted Anticipatory Bail on furnishing surety of Rs.15,000/- and P.R.bond of the like amount. 4.

Perused the papers. Whilst granting Anticipatory Bail to the applicant, it is observed in the order dated 17th November, 2016, that there is an unexplained delay of 15 days in lodging the First Information Report/ complaint; that the FIR appears to be vague and is not supported by any medical or other evidence on record. It is also noted that the possibility of false implication of the applicant cannot be ruled out. 5.

In this view of the matter, the application is allowed and the direction given by this Court vide order dated 17th November, 2016, directing that 'in the event of arrest of the applicant in C.R. No.178/2016, registered with Kurla Police Station, Kurla, he be released on P.R.Bond of Rs.50,000/- with two sureties in the like amount', stands modified. The applicant shall now 'in the event of arrest of the applicant in C.R. No.178/2016, registered with Kurla Police Station, Kurla, he be released on

3/3 P.R.Bond of Rs.15,000/- with two sureties in the like amount. Rest of the conditions imposed vide order dated 17th November, 2016, to remain as it is.
