The order dated 20.02.2015 passed by the Learned President of the Maharashtra Revenue Tribunal, Mumbai condoning the delay of 639 days in filing the application for restoration of the Revision Application came to be allowed is taken exception to by way of the Writ Petition. Having regard to the reasons mentioned in the penultimate paragraph of the impugned order and since the Learned President has deemed it appropriate to exercise discretion, this Court does not deem it appropriate to interfere with the said discretion in its writ jurisdiction. The Writ Petition is accordingly dismissed. However, since the Revision Application is of the year 2009, the Maharashtra Revenue Tribunal is directed to hear and decide the same expeditiously and latest by 31.12.2015. [R.M. SAVANT, J] BGP.
