Heard Dr.Milind Sathe, learned Senior Counsel for the Petitioners and Mr.P.P.Kakade, learned A.G.P. for the State and Mr.Manoj Badgujar, learned Counsel appearing for Respondent No.3. 2.

The issue involved in the present Writ Petition pertains to the land acquisition and the grievance of the petitioners is for noncompliance of the procedure under the Land Acquisition Act,1894, especially in passing of Award in terms of Section 11A of the Land Acquisition Act,1894, the entire acquisition proceedings would stand lapsed. Pertaining to the very same notification in the matter of Writ

pvr 2 15wp6277-13.doc Petition No.4674 of 2015 between "Smt.Aparna Jayprakash Mistry Vs. Pune Municipal Corporation & Ors.", by an order dated 2 March 2017, we have already taken a decision that the award made under Section 11A by a notification dated 28 November 2014 is beyond the period prescribed under Section 11A of the 1894 Act. The learned Counsel for the parties agree that the reliefs in this petition would stand covered by our order in writ petition in 4674 of 2015.

In that view of the matter, the land acquisition proceedings lapses in the present case and accordingly, the petition is disposed of in terms of the order dated 2 March 2017 in writ petition in 4674 of 2015.
