The applicant is seeking restoration of Criminal Application No. 620 of 2016 which was dismissed for nonprosecution on 09/12/2017. By order dated 09/02/2017, the 1/2
6. appp 286.17.doc applicant was directed to implead the first informant as respondent No.2 and to carry out amendment within a period of 2 weeks. It was further directed that if the amendment is not carried out within the stipulated time, the application shall stand dismissed for non-prosecution without further reference to the Court. As the amendment could not be carried out within the stipulated time, application came to be dismissed for nonprosecution. 3.
For the reasons stated in the application, we are of the opinion that sufficient cause is made out for restoration of Criminal Application No. 620 of 2016, hence, Criminal Application No. 620 of 2016 is restored to file. Application is allowed. The applicant to carry out amendment by 28/02/2018. Stand over to 14/03/2018.
