By a reasoned Order dated 21.4.2017 the applicant was granted interim relief.

The learned counsel for the applicant submitted that, as has been noted in the said order, the applicant has already returned the amount of Rs.80,00,000/- to the first informant(Respondent No.2). It is further submitted that the Bank to whom the vehicles in question were hypothecated has taken possession of the said vehicles as the applicant has committed default in making loan Page-1/2

As the grievance of the first informant that the applicant has defalcated a sum Rs.80,00,000/- does not hold field as of today as the first informant has received the amount of Rs.80,00,000/-, this Court is of the view that the present application deserves to be allowed.

In view of the above the interim relief granted by Order dated 21.4.2017 is hereby confirmed. However, the applicant is directed to attend the Investigating Officer on every first Monday of the month between 11.00a.m. and 3.00p.m. till the submission of the final report before the Competent Court.

Application is allowed in the aforesaid terms. 6.
In view of the order passed in the present application the Cri. Application No.301/2017 for intervention does not survive and the same is accordingly disposed off. (A.S.GADKARI, J.) Page-2/2
