DATE : 27th FEBRUARY, 2024 P.C.
1.
Both the parties are present today in the Court. They are
duly identified by respective lawyers. Parties have now settled a dispute amicably. By way of impugned decree, the suit being Suit No.221 of 2011 of the Respondent, namely Mrs. Amarpreet Kaur Chadha came to be partly decreed, whereas the suit filed by Mrs. Gurdip Kaur Chadha being Suit No.2729 of 2015 came to be dismissed. Against which these two Appeals are filed in this Court i.e. First Appeal No.526 of 2020 and First Appeal No.796 of 2020. In view of settlement terms now the Plaintiff in Suit No.221 of 2011 i.e. Mrs. Amarpreet Kaur Chadha has agreed to sell her 1/3 share in the suit property to the Appellant No.3 for consideration of Rs.2,00,00,000/-. There is also receipt of amount of Rs.2,00,00,000/- received by Mrs. Amarpreet Kaur Chadha. Respondent No.3/Mrs.
Raminder Kaur Anand is also present in the Court and has given up her right in the suit property. All the parties to the Appeal accept the position and they have consented to this. The consent terms are already verified by the Registrar (Judicial-I) of this Court. Those are taken on record and marked as Annexure-"X" for the purpose of identification. The sale-deed is also a part of the consent terms which is marked as Annexure-"A" to the consent terms.
2.
This Court thus finds that in view of the consent terms decree needs to be modified. Both these Appeals are thus allowed in terms of consent terms. The decree stands modified accordingly. In terms of the settlement which is taken on record, both these Appeals are disposed of.
3.
Office is directed to quantify the Court fees in view of the settlement terms as the property stands transferred by virtue of this order.
4.
In view of disposal of both these Appeals, all pending Interim Applications stand disposed of.
