DATE: SEPTEMBER 29, 2022 P.C.:- 1] Mr. Mundargi, learned Counsel for the Applicants on instructions made a statement that Application moved under Section 451 of the Cr.P.C. for release of property by the Applicant Amarnath and Co-Accused Ravindranath is not pressed. Sessions Court as such shall pass consequential orders. However, same will not preclude wife of Applicant No.1 to apply for release of Dell Laptop which was allegedly seized during the house search on 12/03/2022. If such application is taken out, same be decided on its own merit by the Sessions Court without being influenced by the pendency of the prosecution against the Applicants.

2] Learned Counsel for the Applicants has placed on record undertaking of the Applicants dated 29/09/2022 in the form of an affidavit wherein it is claimed that amount as mentioned in the affidavit, particularly paragraphs 2 and 3 shall be deposited maintaining the scheduled mentioned therein in the Trial Court. Undertaking is accepted.
3] In that view of the matter, ad-interim protection ordered by this Court on 4/4/2022 stands confirmed, subject to condition, in case of single default in maintaining the above schedule about deposit of the amount in the Trial Court, protection granted shall cease to operate forthwith and it shall be open for the the Investigating Officer to take the Applicants in custody.
4] As such, Applicants, in the event of their arrest in C.R. No.8 of 2022 registered with Cyber Police Station District Pune for the offences punishable under Sections 409, 420, 469, 471 read with Section 34 of the Indian Penal Code, and Section 66-C of the 2/3
Information Technology Act and Sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999, be released on bail on executing P.R. Bond of Rs 25000/- each with one or more sureties in the like amount. Applicants shall neither influence the witnesses in any manner nor tamper with the evidence. Applicants shall attend the Investigating Officer of the concerned Police Station from 10th October 2022 to 14th October, 2022 between 10.00 A.M. and 12.00 Noon and thereafter as and when directed by the Investigating Officer.
