There is an affidavit filed by one Vivek Jadhav affirmed on 29th August 2023, in which paragraphs 3 and 4 read as under:

3. I say that I have gone through the order dated 12.08.1986 annexed at Exhibit B with the petition. By the said order the predecessor of the petitioner has allotted land admeasuring area of 40 R. Gat no.145 (old Gat No.706) of village Jaujibuvachiwadi (Kasurdi) Taluka Daund Dist. Pune.

4. I say that, vide order dated 12.08.1986 the PAP has directed to pay amount of 1387.88 Rs. as occupancy price which is divided in three installments. First installment should be paid before handing over possession of the land which is 488.68 Rs.

At Exhibit C is a copy of the Challan issued by the District Resettlement Officer, Pune on 1st June 1987 having received a sum of Rs.1500/- from Shri G. K. Hadke, whose legal heirs are petitioner, as averred in the petition. Therefore, it is quiet clear that the said Vivek Jadhav has not read the petition. Mr. Thorat states that immediate action will be Meera Jadhav

2/2 27-wp-9007-2022.doc taken to ensure that the allotment is given to petitioner subject to, of course petitioner satisfying the District Resettlement Officer that he is the legal heir of the said Baghubhai Teli. Statement accepted as an undertaking to this court. This handing over will be completed within 4 weeks from today subject to petitioner providing all documents required to prove that he is the legal heir. Petitioner / his representative shall meet the District Resettlement Officer at 11.30 a.m. on 12th September 2023. District Resettlement Officer shall meet petitioner's representative at the time and date mentioned herein.

Petition disposed.
