Pending POCSO Special Case No. 10/2019, the Applicant seeks his enlargement on bail. The trial in the Special Case is in progress. Learned Counsel for the Applicant has relied on the evidence of the prosecution witnesses to contend that the evidence of the informant and of the victim, do not show the complicity of the Applicant in the alleged crime. He is in custody since 2018.

Ms. Dabholkar, learned Prosecutor countered the arguments and submitted that trial will get over within a month from today. In consideration of the facts of the case and particularly that the trial is in the progress, I am not inclined to appreciate the evidence of the prosecution witnesses. Instead, the learned Special Judge in POCSO Special Case No. 10/2019, is requested to conclude the trial preferably before 30 th April, 2022.
