I have gone through the application. The applicant, who is a widow of the original accused no.1 - the appellant in Criminal Appeal No.759 of 2000, states that she does not intend to continue with the present appeal, and that, the appeal may be treated as abated.
I find that the sentence imposed upon the original accused no.1 i.e. the appellant, is also of fine. As such, the appeal does not abate on the death of the said appellant. The appeal having been admitted, needs to be decided on merits, and in accordance with law.
