After the matter was heard at some length, it is agreed between learned Counsel for the parties that the Petition can be disposed of in terms of the following order.

: O R D E R :

i) The impugned order of the Industrial Court, Mumbai, dated 24 February 2016 is set aside. The reversion order passed by the first Petitioner bank on 6 January 2016 is also set aside. The Complainant-workmen, who are represented in the present Petition though the Union, shall appear for the typing examination to be conducted by first Petitioner-Bank at the end of four months from today;

Chittewan 2/2 14a. WP 3852-16.doc ii) The Petitioner bank shall regularize appointment of concerned workmen in the present post subject to the workmen clearing this test;

iii)In the event of the workmen not clearing the dues, the first Petitioner shall be at liberty to revert the workmen to their existing post in the subordinate grade.

iv) All rights and contentions of the parties on merits are kept open; v) Complaint (ULP) No.38 of 2016 before the Industrial Court, Mumbai is disposed of in the above terms.
