The applicant-accused is the complainant at C.R. No.121 of 2015 with Virar police station and is prosecuted for the offence of murder punishable under sections 302, 201 of the Indian Penal Code. 2.

It is the case of the prosecution that on 1.2.2015, her husband Rajanikant Purshottam Pandiya was not found and, therefore, gave complaint on 16.2.2015 to the police that her husband is missing. Pursuant to that, the police started investigating the case and found the body of her husband in a gutter on 18.2.2015. So, the offence of murder was registered.

The learned Counsel for the applicant submits that the applicantaccused is the wife of the deceased. She is innocent and has not 1 / 2

aba.563.2016_904.doc committed any offence and she is falsely implicated in this case. 4.

The learned Prosecutor has opposed the application. 5.

This is a first date. However, it is a case of murder. After going through the remand report, I am of the view that this is not a fit case to grant to pre-arrest bail. The custody of the applicant-accused is required. Hence, the Anticipatory Bail Application is rejected. (MRIDULA BHATKAR, J.) 2 / 2
