By this Application, the Applicant is seeking bail in Crime No.18 of 2020 registered with Kulgaon Police Station, MIDC Badlapur, District-Thane for the offences punishable under Section 302, 120B and 201 read with Section 34 of the Indian Penal Code ('IPC' for short).

It is contention of the learned counsel for the Applicant, that, this Court (Coram: Prakash D. Naik, J.) by order Digitally signed by NILAM SANTOSH KAMBLE Date:

Viraj Bharat Palande. The role attributed to the Accused No.1 is identical to the Applicant. Hence, Applicant be released on bail. 3.

The learned APP submitted that, appropriate order be passed.

I have heard both learned counsel. Perused FIR and Charge-sheet.

The police has arrested Applicant and co-accused on the charges of murder of deceased. The co-accused whose role is identical with the Applicant has been released on bail by this Court (Coram : Prakash D. Naik, J.). The said order has not been challenged. Hence Applicant is entitled for bail on the ground of parity.

In view of above, I pass following order.

ORDER

(i) The Applicant be released on bail in Crime No.18 of 2020 registered with Kulgaon Police Station, MIDC Badlapur, District-Thane, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall report Kulgaon Police Station, MIDC Badlapur once in a month on every first Saturday between 11.00 a.m. to 1.00 p.m., till further orders.

(iii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses. (iv) Application is allowed in the aforesaid terms. (SHIVKUMAR DIGE, J.) N.S. Kamble page 3 of 3
