Having gone through the averments made in the application, we are satisfied that there was sufficient cause for the non appearance of the counsel when the case was called out. In the circumstances, we allow the Civil Application and order restoration of the Family Court Appeal No. 215 of 2008 to its original number. 3.

Issue notice on Memo of appeal to the respondents. Steps be taken within two weeks. In addition to usual court notice, service by private notice is also permitted.

List the appeal after four weeks.
